FINE MARKETS TERMS AND CONDITIONS

1. INTRODUCTION
1.1 FINE MARKETS (“FINE MARKETS”, “the Company”, “We”, “Us” or “Our”) is an investment firm legally registered and governed by the applicable laws and regulations of its jurisdiction.
1.2 These Terms and Conditions form part of the Client Agreement and govern the relationship between you (“the Client”) and FINE MARKETS.
1.3 The Client confirms that they have taken sufficient time to carefully read, understand, and accept these Terms and Conditions and refer to the Legal Documents provided on FINE MARKETS’ official website.
1.4 If the Client does not understand or has objections to any part of these Terms and Conditions, they must contact FINE MARKETS in writing prior to opening an account.
2. ACKNOWLEDGEMENT
2.1 The Client acknowledges that they fully understand these Terms and Conditions, as updated from time to time, in addition to any Legal Documents provided on the official website.
2.2 By accepting these Terms and Conditions, the Client enters into a legally binding agreement with FINE MARKETS.
2.3 The Client accepts that the Company’s official language is English and that acceptance through electronic means (e.g., clicking accept/agree/submit) is deemed equivalent to a physical signature.
2.4 The Client has the right to withdraw their consent for electronic delivery at any time by written notice. However, this may restrict or terminate the Client’s access to the Online Trading Facility.
2.5 A copy of these Terms and Conditions should be printed and retained for the Client’s records.
3. SCOPE
3.1 These Terms govern all actions related to the execution of Client orders.
3.2 These Terms override any other previous agreements, statements or arrangements unless explicitly agreed otherwise in writing by FINE MARKETS.
4. COMMENCEMENT AND DURATION
4.1 The Agreement commences once the Client’s account is activated after due diligence and KYC procedures are completed.
4.2 The Client may withdraw from the Agreement within three (3) calendar days of account activation if no trades have been made.
4.3 If not withdrawn, the Agreement remains effective until terminated according to the Termination section.
5. SERVICES
5.1 Subject to the Client fulfilling obligations under the Legal Documents, FINE MARKETS may offer investment services including reception, transmission, and execution of orders for financial instruments.
5.2 Ancillary services may include safekeeping, administration, and related services such as cash management.
5.3 The Client understands that CFDs are derivative products and do not grant ownership of underlying assets.
5.4 FINE MARKETS does not provide investment advice. The Client should seek independent advice if necessary.
6. OPENING AN ACCOUNT
6.1 After submitting all required documentation, FINE MARKETS will perform KYC checks and notify the Client if they are accepted. An account will be created and activated upon initial deposit.
7. RISK ACKNOWLEDGEMENT
7.1 Trading in financial markets involves significant risk. The Client may lose part or all of their invested capital.
7.2 The Client must read and understand the “Risk Disclosure Notice” available on the official website.
8. CLIENT CATEGORIZATION
8.1 Clients will be categorized as Retail or Professional Clients and notified in writing.
8.2 Re-categorization requests are subject to FINE MARKETS’ discretion.
9. APPLICABLE LAW
9.1 This Agreement is governed by the laws of FINE MARKETS’ operating jurisdiction. Any disputes shall be settled in the competent courts of that jurisdiction.
10.PERSONAL DATA AND CONFIDENTIALITY
10.1 By entering into this Agreement, the Client consents to FINE MARKETS storing and processing their data as required by law.
10.2 Personal information will not be disclosed to third parties without consent except where required by law or necessary to provide services.
11.TERMINATION
11.1 The Client may terminate this Agreement by providing seven (7) days written notice, subject to no open positions or outstanding obligations.
11.2 FINE MARKETS may terminate the Agreement immediately under certain conditions, including breach of terms or applicable laws.
12.LIABILITY AND
12.1 FINE MARKETS shall not be liable for any indirect or consequential losses.
12.2 The Client agrees to indemnify FINE MARKETS against any claims arising from misuse or breach of this Agreement.
